By visiting this Site or using the Service, you are accepting the policies and practices described in this Policy, as such Policy may be amended from time to time. Each time you visit the Site or use the Service, you agree and expressly consent to our collection, use and disclosure of the information that you provide as described in this Policy.
To be clear about the terminology we are using, when we use the phrase "Personal Information" in this Policy, we mean information about you that is personally identifiable, like your name, address, e-mail address, billing information, or phone number, as well as other non-public information that is associated with this personal information. When we use the phrase "Anonymous Information" in this Policy, we mean information that is not personally identifiable, or linked to your Personal Information such as aggregated information, general demographic information and IP addresses. Anonymous Information does not necessarily enable identification of individual persons.
When you install the YayFon App or register on the Site, you will be asked to provide us with your phone number, name and a photo (name and photo are not mandatory) and to allow us access to your mobile device's address book.
A copy of the phone numbers and names in your address book (but not emails, notes or any other Personal Information in your address book) will be stored on our servers and will only be used to:
The copy of your address book (names and phones) is stored on a live database. This database does not have a "historical backup". If you delete the address book from our servers (more about this below), it will be deleted instantly and permanently.
Your phone number will be used for identification purposes as your YayFon user ID.
Since YayFon users may add your YayFon number to their address book and see that you registered to YayFon, we do not consider the fact that your YayFon number exists on YayFon as private information.
YayFon also maintains a Call Detail Record (CDR - see http://en.wikipedia.org/wiki/Call_detail_record) for each call that goes through the system. These are industry standard records used by all phone companies. We maintain this information in order to better understand network behavior and trends (numbers of messages and calls made by users, typical destinations, call lengths, network type, etc.), detect potential outages and technical issues (this helps us notice things like a drop in call volume in a certain geography, a shift in call length, a change in typical networks, etc.) and for public safety reasons. All log analysis is done in an anonymous, aggregate, non-personally identifiable manner. We may look into a specific Call Detail Record in response to a customer support request. We maintain CDRs for a period of no more than 12 months.
Audio calls by users are transmitted either directly from user to user or, if direct transmission is not possible (due to, for example, firewalls), YayFon servers are used to transmit the call. In the latter scenario, the information transmitted is stored briefly in volatile memory (RAM) solely to enable the transmission of the call to the other user. WE DO NOT RECORD ANY PART OF YOUR CALL.
YayFon may interact with your phone's SMS inbox or call history for the sole purpose of service activation, placing incoming messages in your inbox, reading the contents of the activation SMS sent to you by YayFon. WE WILL NOT ACCESS THE CONTENTS OF ANY OTHER SMS.
Should you provide your name and/or photo it will be visible to other YayFon users as long as: Such users have your YayFon number.
We will not link any Personal Information, including e-mail addresses, with aggregate data of our users. Any or all of these activities with regard to Site usage information may be performed on our behalf by our service providers, including, for example, our analytics vendor(s) and our e-mail management partner(s).
We will never (and will not allow any third party to) use the statistical analytics tool to track or to collect any Personal Information of visitors or users. Google will not associate your IP address with any other data held by Google. Neither we nor Google will link, or seek to link, an IP address with the identity of a device user. We will not associate any data gathered from this site with any Personally Identifiable Information from any source, unless you explicitly submit that information via a fill-in form on our website.
We do not rent, sell, or share any information about our users with any third-parties, except as specifically described herein. We may disclose your Personal Information if we believe such action is necessary to
In order to provide you with YayFon products you have requested, YayFon may sometimes, if necessary, share your Personal Information (excluding your address book and related information) and traffic data with trusted partner service providers and/or agents, for example: banking organizations or other providers of payment and analytical services, customer support, or hosting services. YayFon will always require these third parties to take appropriate organizational and technical measures to protect your personal data and traffic data and to observe the relevant legislation. YayFon will never share your address book information with any third party, except as may be required by law (see below).
The following is a description of how we may share your Personal Information with trusted third party partners. Should we add additional partners, we will immediately update this description:
YayFon OÜ ("we" or "us" or "our" or other similar pronouns) offers you ("you" or "your") calling services through YayFon’s licensed software application ("Licensed Application") for mobile devices available on YayFon’s website at www.yayfon.com ("Site") or other third party websites. The Site, the Licensed Application and the various YayFon services offered to you may be collectively referred to in these terms as the "Service". You understand that, just like a regular mobile phone service, anyone with knowledge of your phone number may call you through our Licensed Application. Our Licensed Application is licensed, not sold, to you for use only under the terms of this license, unless a product or service is accompanied by a separate license agreement, in which case the terms of that separate license agreement will govern, subject to your prior acceptance of that separate license agreement. We reserve all rights not expressly granted to you. This license is a binding legal document between YayFon and you and explains your rights and obligations as a user of the Service ("License"). By using the Service you acknowledge and agree to the terms of this License, all of which are incorporated by herein by reference. If you choose to not agree with any of these terms, you may not use the Service.
NO ACCESS TO EMERGENCY SERVICES: YayFon is not a replacement for your ordinary mobile or fixed line telephone and does not allow you to make emergency calls to emergency services. You must make alternative communication arrangements to ensure that you can make emergency calls if needed.
CHECK RESTRICTIONS ON USE: In some countries there are restrictions on the use of the Licensed Application. It is your responsibility to ensure that you are legally allowed to use YayFon where you are located.
